New Terms of Use Agreement

On November 10th, 2015, we officially updated our forum's terms of service to account for the Code of Conduct added earlier this year. This article, aside from announcing this change, is meant to explain the exact changes we've made and reassure all of our users that nothing has changed for their site use experience.

For reference, this is the original terms of service of the website:

By accessing “trekcc.org” (hereinafter “we”, “us”, “our”, “trekcc.org”, “https://www.trekcc.org/forum”), you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use “trekcc.org”. We may change these at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage of “trekcc.org” after changes mean you agree to be legally bound by these terms as they are updated and/or amended.

Our forums are powered by phpBB (hereinafter “they”, “them”, “their”, “phpBB software”, “www.phpbb.com”, “phpBB Group”, “phpBB Teams”) which is a bulletin board solution released under the “General Public License” (hereinafter “GPL”) and can be downloaded from http://www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct. For further information about phpBB, please see: http://www.phpbb.com/.

You agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where “trekcc.org” is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that “trekcc.org” have the right to remove, edit, move or close any topic at any time should we see fit. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither “trekcc.org” nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

This version of the agreement is the default text that comes with phpBB, the software that powers our forums. Other than the customization (including our website URL), this text is identical to the default text from phpBB circa 2008. It's been in place as long as the forums have been active, and all users on the site agreed to these terms when creating their accounts.

Here is the new, current terms of service, updated so that you can see exactly what's changed. Text that is new or changed is in bold:

By accessing “trekcc.org” (hereinafter “we”, “us”, “our”, “trekcc.org”, “https://www.trekcc.org/forum”, "The Continuing Committee"), you agree to be bound by the following terms.

While accessing "trekcc.org," the Code of Conduct is in effect; the full Code of Conduct may be viewed at: https://www.trekcc.org/forum/codeofconduct.php. The Code of Conduct prohibits, in part, posting about or links to: vendors selling unlicensed Star Trek-related merchandise, content that is illegal or encourages or condones illegal activity, content that includes graphic violence or explicit sexual content.

Additionally, users are prohibited from posting any comment or remark that is belittling, disparaging, denigrating, harassing, threatening, bullying, or cruel towards another person; nor any content or remark that would be perceived by a reasonable bystander to be belittling, disparaging, denigrating, harassing, threatening, bullying, or cruel; nor shall any user post such content directed against any discrete category or class of persons.

The Continuing Committee is dedicated to providing a harassment-free experience for everyone, regardless of gender, sexual orientation, disability, physical appearance, body size, race, religion, species, or affiliation. We do not tolerate harassment of forum, chatroom, and tournament participants in any form. In addition, members are explicitly prohibited from threatening speech of any kind, including that against any person, group, or community, including this website. Participants violating these rules may be sanctioned or expelled at the discretion of management. If you need to report an issue you may do so by emailing moderators@trekcc.org.

As you can see, nearly the entirety of the "legalese" was retained and remains unchanged. The changes primarily include adding the Code of Conduct to the terms themselves, and spelling out that violating those terms may result in action. Enforcement of these rules still remains in the full control of the moderators, and not in the hands of the CC or its members.

The most significant change is the addition of a harassment policy, guaranteeing members of the community and tournament participants protection from threatening or harassing behavior. This is a standard protection included on most, if not all, online forums and by most, if not all, companies that provide tournament support. Harassment is rare, but ugly, and we want to make sure that if it happens, everyone in the community is protected and knows there is a way to report the behavior.

These changes were made by volunteers of the Continuing Committee, working together. The sole motivation behind these changes was to make sure we were presenting a genuine picture of our expectations for use of the forums, the chat room, and the site in general. Accepting the terms of service is not required for participation in tournaments, or accessing the majority of the content on the site. It is only required to access the forums, and, again, the text of the terms of service is the de facto status quo: nothing has changed for existing forum users, except education.

We apologize for any confusion the sudden deployment of this change might have caused. It was an oversight on our part not to have this article on the front page posted and ready to go at the same time the new terms of service were rolled out. For that, we apologize as well.
