I would say that's OBE now that putting bunches of cards under Ferenginar by throwing engagements is now a legitimate strategy. It was way harder before that to get lots cards under there, making it easier to keep track of.
OR, since it much easier to get lots of cards under Ferenginar now, perhaps not being allowed to freely examine those cards can offset an abusive, NPE for the opposing player?
I've seen no evidence that that strategy is abusive or NPE. In fact the comments I'd seen around it talked about how difficult it was to get it to set up and run in any kind of consistent and effective manner. If your opponent is running a different quadrant or low attribute ships it gets even tougher.
In any event, with the conceptual idea of Fereginar as a "bank" of sorts, not being able to look under it make little sense in my opinion. No one would like to have no access to their account balance after making a deposit.
TL;DR this needs a ruling either way.
