the way i read it. it checks for most cunning present first, then if that is opponents personnel, he captures. meaning if he himself is the most cunning present or any of your own personnel, he cant capture anymore

This card (as per the capture rules) can only target opposing personnel, therefore you only check among the legal targets. So it a 5 cunning person is the highest your opponent has. He captures them.

the rules say you cant capture your own personnel. I dont see the cunning check is exclusive to your opponents personnel though.

But whenver you check something you only check legal targets.

"legal target" is pretty irrelevant when cards override game rules all the time. i could argue noah allows the capture of your own personnel even.

There already are a thousand or more cards that do this in 1E. Any card that allows you to do something not written in the rulebook, essentially.

i guess its game rules, unless the card specifically allows otherwise. meaning noah would read (even your own personnel)

The glossary says you may never capture your personel. That is the most specific rule on the issue in the game. Therefore, you cannot
